The cornerstone of commercial law is the law of contracts. Contracts are part of the sale of real estate, leases of all types, promissory notes and mortgages, the sale of goods, the performance of professional services, partnerships and many other types of commercial transactions.

Contracts are created where promises are exchanged between persons or companies or by the conduct of a person or company or by the law to avoid injustice. A contract is breached where someone does not perform his, her or its promise.

Contracts can be in writing or oral. Sometimes, oral contracts will not be enforced by the courts because certain contract are required to be in writing or are in conflict with written contracts involving the same transaction.

Although the basic concept of contracts is fairly simple, contracts can involve: (1) someone being induced to enter into a contract by fraud; (2) the intent of the parties are not clear; (3) did a breach occur or not; (5) is someone entitled to attorneys fees; and (6) many other issues.

Where a breach of contract has caused damages to you, you have the right to recover such damages against the person breaching the contract.
