When you hire a professional, you are entering into a contract for that professional to provide services to you and for you to pay for such services. In every professional services contract, the law implies that the professional shall use due care in providing services to you. Due care means your hired professional is required to use the same care used by other professionals. The types of professional you will probably hire are, at least, architects, engineers, attorneys, accountants, consultants of all types, real estate sales persons and brokers, and stockbrokers.

By law, certain professionals are fiduciaries of their clients. Your attorney, real estate sales person and broker and stockbroker are fiduciaries. As fiduciaries, these professionals owe you duties of due care, full disclosure, utmost good faith and fair dealing. In addition, many professionals are licensed and regulated under federal and/or state law.

Where a professional has breached his contract with you or any of the duties owed to you, you have the right to recover your damages caused by such a breach.
