When you are faced with a legal issue, problem or dispute,
you do not have to necessarily or immediately file a lawsuit. You can have
an attorney review your case and assist you in negotiating a reasonable resolution
of the issue, problem or dispute.
When you consult an attorney to review of your case, the attorney will ask for key
facts that he needs to determine what law applies, whether your rights have been
violated and to calculate your damages or determine what corrective action that is
required. After a review of your case, you can negotiate with the other person or
company for the payment of money or a correction of a wrong.
You may take the position that you need to play "hard ball" and "engage
in thermal nuclear" legal war, however, an attempt to negotiate a resolution
before the litigation starts, at a minimum, gives you comfort that litigation was
necessary.
