In real estate, issues, problems and disputes arise in the
areas of title to, transactions involving and governmental or private limitations
upon your property interests.
Real estate ownership can be fee simple, leasehold, easements and licenses. In Hawaii,
these ownership interests are usually recorded in the bureau of conveyances or the
land court. Problems arise from: (1) breaks in the chain of title (missing documents
in the recorded title); (2) encroachments by neighbors and (3) claims made by individuals
and groups upon your title.
In real estate transactions, issues, problems and disputes between sellers and buyers
or between lessors and lessees arise where: (1) someone in induced to sell or purchase
real estate by fraud; (2) someone breaches the agreement (does not want to sell or
buy); (3) someone breaches representations or warranties in the agreement; (4) undisclosed
material facts that affect the usefulness or value of the property; and (5) many
other problems.
Also, real estate sales persons and brokers, attorneys and consultants may be involved
in real estate transactions. All of such persons may have duties to you of varying
degrees. Such relationships and duties are described in our page concerning professionals.
In Hawaii, there exists numerous statutes, ordinances and private limitations and
restrictions on real estate. As a result of such public and private limitations and
restrictions, issues, problems and disputes arise where: (1) zoning laws restrict
the use of your property; (2) zoning codes require a certain number of parking spaces;
(3) private covenants limit the height of your home; (4) a shopping center lease
limits your rights in the common areas of the shopping center; and (5) many other
problems.
